1. Acceptance of Terms
By accessing and using Pawfect Fwiend ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Sam Houston Labs Ltd.
2. Description of Service
Pawfect Fwiend is an AI-powered pet behavioral analysis platform that: • Detects pets (dogs and cats) in your videos on your device • Analyzes pet behaviour using third-party AI services • Generates behavioural interpretations and captions (AI-generated, and may be inaccurate) • Stores your analysis history and memories • Provides real-time camera analysis • Offers a shared Explore map of user-submitted places, events, and posts • Includes Walk & Conquer, a location-based game that awards map territory as you walk Important Disclaimer: This Service is for entertainment and educational purposes only. It is NOT: • A substitute for professional veterinary advice • A substitute for animal behavior consultation • A substitute for professional training services • Medical or diagnostic in nature • Guaranteed to be 100% accurate Always consult with a licensed veterinarian or professional animal behaviorist for serious concerns.
3. User Responsibilities
You agree to: • Use the Service only for lawful purposes and in compliance with all applicable laws • Not upload content that: - Violates any laws or regulations - Infringes on third-party intellectual property rights - Contains animal abuse or cruelty - Contains explicit or harmful content - Violates anyone's privacy or rights • Not attempt to: - Reverse engineer or hack the Service - Bypass security measures - Scrape or automate access - Resell or redistribute the Service • Respect animal welfare and safety at all times • Not rely solely on the Service for animal safety decisions • Obtain necessary permissions before recording animals or people • Maintain the confidentiality of your account credentials
4. Camera, Location and Permissions
The live camera feature requires camera permission from your browser or device. By granting permission, you: • Confirm you have the legal right to record in your location • Understand that live sessions are NOT saved unless you explicitly save them • Accept that camera access is only used while the camera feature is active • Can revoke camera permission at any time through your device settings • Understand that microphone access is used during live analysis only to derive on-device acoustic cues (such as ambient sound level); only those numeric cues are sent to our analysis engine, never the raw audio waveform, and audio in any session you save is anonymised on your device when biometric anonymity is enabled • Consent to the processing of video frames by Mistral AI (our behavioural analysis engine) when you request analysis; human faces are blurred on your device and again on our servers before any frame is stored Location features: the Explore map and the Walk & Conquer game use your device's precise location. In Walk & Conquer, location is used only while you are actively playing, in the foreground, to track your route and award map territory. Location access is consent-gated and revocable at any time in your device settings; we do not track your location in the background. You confirm you have the right to be in the locations you visit. Play safely: obey all laws and traffic rules, stay aware of your surroundings, and do not play while driving or in unsafe places. We are not responsible for any injury, loss, or damage arising from your movement while using location features.
5. Content Ownership and License
Content Ownership: • You retain full ownership of all videos and images you upload • You retain all intellectual property rights to your content • We do not claim ownership of your content License Grant: • By uploading content, you grant us a non-exclusive license to: - Process and analyze your content - Store your content securely - Display your content in your account - Use anonymized data to improve the Service • This license is limited to providing the Service • We will not sell or share your content with third parties Content Removal: • You can delete your content at any time • Deleted content is permanently removed within 30 days • We may retain anonymized analysis data for service improvement
6. AI-Generated Content
Important Disclaimers: • All behavioral interpretations and captions are generated by AI • AI-generated content should be treated as entertainment, not fact • The Service cannot guarantee accuracy of interpretations • AI may have limitations, biases, or errors • Always prioritize direct observation and professional advice • Do NOT make important decisions based solely on AI interpretations Accuracy: • Detection accuracy depends on video quality, lighting, and pet visibility • Some pets may not be detected due to technical limitations • Behavioral interpretations are probabilistic, not deterministic • We are continuously improving accuracy through model updates
7. Credits, Subscriptions and Payments
Credits and Subscriptions: • Each video analysis costs 1 credit • Credits are included with your subscription tier and replenish each billing cycle • Subscriptions are managed through the mobile app's in-app purchases (Apple App Store on iOS, Google Play on Android) • Unused credits do not carry over and are non-refundable • You can view your credit balance and subscription status in Settings Refunds: • In-app purchases follow the app store policies: - Apple App Store: 14-day refund window - Google Play Store: refunds per Google Play policies • Failed analyses due to technical errors are refunded automatically • No refunds for videos where no pet is detected (technical limitation) • No refunds for AI interpretation accuracy Payment: • Payments are processed by Apple (App Store) on iOS and by Google Play on Android through in-app purchases • We do not receive or store your payment card number; only non-sensitive metadata (subscription tier, status, next billing date) reaches our systems • Payment disputes should be directed to the relevant app store (Apple App Store or Google Play)
8. Detection Limitations
Technical Limitations: Our pet detection system uses a pet-detection model with a confidence threshold. Some videos may be rejected if: • The pet is too small or far from camera • The pet is partially obscured or hidden • Poor lighting or low video quality • Unusual angles or positions • Non-standard pet breeds or mixed breeds • Multiple pets in frame (we process the largest pet) These are technical limitations of machine learning, not service restrictions. We are continuously improving detection accuracy through: • Model updates and retraining • User feedback and corrections • Expanded training datasets • Performance monitoring and optimization
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do NOT guarantee that: • The Service will be error-free or uninterrupted • The Service will be secure or free from malware • AI interpretations will be accurate or complete • Detection will work for all pets or videos • The Service will meet your specific needs • Any particular results will be achieved We are NOT responsible for: • Any decisions made based on AI-generated content • Animal injuries or behavioral issues • Loss of data or content • Service interruptions or downtime • Third-party services or content
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for: • Indirect, incidental, special, or consequential damages • Lost profits, lost revenue, or lost data • Animal injuries or behavioral issues • Decisions made based on AI interpretations • Third-party claims or actions • Service interruptions or downtime Maximum Liability: • Our total liability shall not exceed the amount you paid for the Service in the past 12 months • Some jurisdictions do not allow limitation of liability, so this may not apply to you
11. Acceptable Use Policy
Prohibited Activities: You agree NOT to: • Upload content depicting animal abuse or cruelty • Use the Service for illegal purposes • Attempt to hack or reverse engineer the Service • Scrape or automate access to the Service • Resell or redistribute the Service • Harass or abuse other users • Spam or send unsolicited messages • Violate anyone's privacy or intellectual property rights • Bypass security measures or access controls • Interfere with Service operations User-Generated Map Content and Community Guidelines: • The Explore map lets you add businesses, events, and posts. This content is user-generated and visible to other users; you are solely responsible for what you submit and confirm you have the right to share it • Do NOT submit map content that is false or misleading, that impersonates a business or person, that is spam or unauthorised advertising, or that is illegal, hateful, harassing, or infringing of anyone's rights or privacy • Other users can report or block content. We may review, refuse, remove, reinstate, or take down any user-generated content at our discretion, and may suspend accounts that breach these guidelines, without prior notice where necessary to protect users or comply with the law • You can edit or delete content you created at any time Enforcement: • We reserve the right to investigate violations • We may suspend or terminate your account for violations • We may report illegal activity to authorities • We may pursue legal action for damages
12. Termination
Termination by Us: We reserve the right to suspend or terminate your access to the Service at any time for: • Violations of these Terms • Violations of applicable laws • Abuse or harassment • Non-payment of fees • Any other reason at our discretion Termination by You: • You may terminate your account at any time through the Settings page • Upon termination, your data will be deleted within 30 days • You will not receive a refund for unused credits Effect of Termination: • Your access to the Service will be immediately revoked • Your data will be permanently deleted • Provisions that survive termination will remain in effect
13. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via: • Email notification • In-app notification • Website banner Continued use of the Service after changes constitutes acceptance of the new Terms. We recommend reviewing these Terms periodically for updates. If you do not agree to the updated Terms, you must stop using the Service.
14. Governing Law and Dispute Resolution
Governing Law: These Terms are governed by the laws of England and Wales, without regard to its conflict of law provisions. Dispute Resolution: • Informal Resolution: Before pursuing legal action, contact us at team@samhoustonlabs.com • Arbitration: Any disputes shall be resolved through binding arbitration • Class Action Waiver: You agree not to participate in class action lawsuits • Venue: Any legal proceedings shall be in England and Wales Exceptions: • We may seek injunctive relief for intellectual property violations • Small claims court is available for claims under £10,000
15. Intellectual Property
Our IP: • All rights to the Service, platform, algorithms, and UI belong to Sam Houston Labs Ltd • "Pawfect Fwiend" and our logo are trademarks • You may not use our trademarks without permission Your IP: • You retain ownership of your uploaded content • You grant us a license to process and store your content • You are responsible for ensuring you have rights to upload content Feedback: • Any feedback you provide may be used to improve the Service • We may use your feedback without compensation or attribution
16. Third-Party Services
We use the following third-party services: • Mistral AI: Behavioral analysis and caption generation - Mistral's terms of service apply - Selected video frames are processed by Mistral AI • Google Gemini: Optional pet-image generation only (not behavioural analysis) - Google's terms of service apply - Used only when you explicitly request a generated image • Firebase: Authentication, database, and storage - Google's privacy policy applies - Your data is stored in Google's infrastructure • Modal and RunPod: Behavioural and video analysis compute - Modal runs the serverless GPU analysis (United States); a RunPod EU-resident GPU serves users in the EU - Temporary files are deleted after 30 days • Apple In-App Purchases: iOS subscription billing - Apple's terms of service apply - Apple handles all iOS payment data • Google Play Billing: Android subscription billing - Google's terms of service apply - Google handles all Android payment data • Hostinger (EU) and Codemagic (EU): server hosting and build pipeline - Infrastructure providers acting on our behalf - See our Privacy Policy for the full sub-processor list and data locations • MediaPipe (on-device face blur) and on-device detection models: pet detection and bystander face anonymisation - Open-source components - On-device and on-server processing; no extra third-party involvement We are not responsible for third-party services or their policies.

18. Entire Agreement
